Who can file a wrongful death claim in Florida?+
Only the personal representative of the deceased's estate may file the claim. The proceeds are then distributed to statutory survivors — spouse, children, and (in some cases) parents. If there is no will naming a personal representative, the court appoints one.
What damages can be recovered?+
Lost financial support, services the deceased provided, loss of companionship and mental pain for surviving spouse and minor children, medical and funeral expenses, and the value of lost earnings and net accumulations to the estate.
How long do I have to file?+
2 years from the date of death (Fla. Stat. §95.11(4)(d)). Medical negligence wrongful-death claims have additional pre-suit notice requirements. Do not wait.
