Florida Motorcycle Accident Attorneys
Down on US-1 or A1A? We fight the rider-bias defense.
Florida is one of the most dangerous states for motorcyclists — open roads, year-round riding, and drivers who do not check twice. Florida law (Fla. Stat. §316.211) requires helmets only for riders under 21 unless they carry $10,000 medical coverage. Insurers often try to blame the rider; we counter that with reconstruction, witness work, and helmet-law analysis.

Case Types
Left-Turn Collisions
Most common motorcycle crash. Driver turns left across the rider's path. Liability is usually clear; the fight is over damages.
Lane-Change / Blind Spot
Driver merges into the lane occupied by a motorcycle. Helmet-cam, dashcam, and traffic-cam footage are critical evidence.
Road-Hazard Cases
Potholes, debris, uneven pavement, and construction-zone defects. Government-entity claims are capped under Fla. Stat. §768.28.
Uninsured Motorist (UM)
Florida does not require bodily-injury coverage. UM is often the only practical recovery source. We review your motorcycle policy on day one.
Catastrophic Injury & TBI
Traumatic brain injury, spinal-cord injury, amputation, and burn injuries. Life-care plans and economist projections drive these claims.

Frequently Asked Questions
Does Florida require motorcycle helmets?+
Only for riders under 21, or riders 21+ who do not carry at least $10,000 in medical insurance (Fla. Stat. §316.211). Choosing not to wear a helmet does not bar your claim, but insurers may use it to argue increased injury — we counter with biomechanics and accident-reconstruction analysis.
Does Florida PIP cover motorcycle riders?+
No. Motorcycles are excluded from Florida's PIP no-fault system. That makes UM coverage and the at-fault driver's liability policy especially important. Many riders carry MedPay as a substitute for PIP.
What is the comparative fault risk for motorcyclists?+
Florida's 2023 modified comparative negligence rule (Fla. Stat. §768.81) bars recovery if you are more than 50% at fault. Defense lawyers often try to push rider fault above 50% using helmet-law, speed, or lane-position arguments. We fight that posture aggressively.
