Florida Bicycle Accident Attorneys

YO PELEO™

Cyclists have the same rights as drivers. We make sure that is enforced.

Florida averages over 6,000 reported bicycle crashes per year — and consistently ranks in the top three states for cyclist fatalities. Under Fla. Stat. §316.2065, cyclists have all the rights and duties of drivers. Drivers passing a cyclist must allow at least 3 feet of clearance. Our attorneys handle dooring incidents, hit-from-behind cases, intersection strikes, and uninsured-motorist claims for cyclists.

Case Types

Dooring Incidents

Driver opens door into a passing cyclist. Liability is typically the door-opener's under Fla. Stat. §316.2005.

3-Foot Rule Violations

Florida's 3-foot passing rule. Sideswipe and clip-and-flee cases.

Intersection Strikes

Driver turning right into cyclist, or left across cyclist's path. Traffic-camera footage is often the key.

Hit-from-Behind

Distracted-driver cases. Phone records and dashcam footage drive liability.

UM Claims for Cyclists

A cyclist hit by an uninsured driver can claim under the cyclist's own auto UM policy — even though they were on a bike.

Frequently Asked Questions

Does Florida PIP cover cyclists?+

PIP follows the auto policy, not the cyclist. If you own a car with PIP, your PIP can cover medical bills even if you were on your bike when struck. If you do not own a car, the at-fault driver's liability policy is the primary source.

Is helmet use required in Florida?+

Only for cyclists under 16. For adults, choosing not to wear a helmet does not bar recovery but may be raised by the defense on head-injury claims.

Where am I allowed to ride in Florida?+

Cyclists must use the road like other vehicles when riding at less than normal traffic speed; you must use the right side of the road or designated bike lane. Sidewalk riding is allowed unless a local ordinance prohibits it (Fla. Stat. §316.2065).
