Marriage-Based Green Card

The fastest path to permanent residence for spouses. YO PELEO™ POR TI to secure your spouse's green card.

How long does a marriage green card take in Florida?

For a spouse already in the United States, adjustment of status usually takes about 8 to 14 months from filing Forms I-130 and I-485 to the green card. If your spouse is abroad, consular processing through the National Visa Center generally runs 12 to 18 months. Spouses of U.S. citizens are immediate relatives, so no visa-number backlog adds to that wait.

Marriage green card FAQs

What evidence proves a bona fide marriage?

USCIS looks for proof that you built a life together, not a single document. The strongest files combine joint financial records (a shared lease or mortgage, joint bank accounts, insurance naming each other), evidence you live at the same address, photographs across time with family and friends, and sworn statements from people who know you both. Volume matters less than range.

What is the difference between a CR-1 and an IR-1 green card?

It comes down to how long you have been married when the green card is approved. Under two years and your spouse receives a CR-1, a conditional card valid for two years. Two years or more and it is an IR-1, valid for ten. CR-1 holders must file Form I-751 to remove the conditions before the card expires.

What happens at the marriage green card interview?

A USCIS officer confirms your identities, reviews the petition, and tests whether the marriage is genuine. Most couples are interviewed together and asked about daily life, how you met, and your plans. Bring originals of everything you filed. Separate interviews (sometimes called a Stokes interview) happen only when the officer has specific doubts.

Can I get a marriage green card if I entered the country unlawfully?

Sometimes, but it changes the path. Adjustment of status inside the United States generally requires a lawful entry, so an unlawful entry often means consular processing abroad instead — which can trigger a three or ten year bar requiring a waiver. Some exceptions exist, including for certain people with an old approved petition. This is the point to get advice before filing anything.
