Attorney Helping Family Members Apply for Immigration Visas in Windermere, Apopka, and Orange County

For many people, the ideal path for immigration involves sponsorship by a family member who is currently living in the United States. A U.S. citizen or a lawful permanent resident who has a valid Green Card can sponsor foreign family members when applying for visas that will allow them to live in the United States permanently. Those who are involved in family-based immigration cases will need to understand the types of visas they may qualify for, and a family can work with an attorney to complete the application process successfully.

The Vasquez Law Firm, PLLC provides legal help to families in immigration cases, ensuring that they follow the correct steps and provide the right documents when applying for visas. Our lawyers have a combined total of over 35 years of legal experience, and we have helped our clients address multiple types of issues related to immigration. In addition to assisting with immigration visas, we also provide legal help with applying for waivers of inadmissibility, defending against deportation, and attaining citizenship.

Types of Visas Available to Family Members

A person can sponsor their family members for immigrant visas that will give them the authorization to enter the United States. Upon entry, immigrants will be able to receive a Green Card recognizing them as lawful permanent residents, and they will have the right to live in the U.S. and seek employment. When sponsoring a family member for immigration, a person will need to provide an affidavit of support. This affidavit will show that the sponsor will have the financial means to support all family members who will be coming to the U.S., and it will serve as a legally enforceable contract giving the sponsor the responsibility to provide for their family members' needs.

Visas available in family-based immigration cases include:

  • Immediate relative (IR) visas - A U.S. citizen can sponsor their spouse and minor children for these types of visas. Children must be under the age of 21 and unmarried. If the citizen is at least 21 years old, they may also sponsor their parents. IR visas are typically available with no waiting period and no limitations on the number of visas that can be issued.
  • Family preference (F) visas - A U.S. citizen can sponsor more distant relatives for these types of visas, including siblings or children who are married or over the age of 21. Green Card holders may sponsor their spouses or unmarried children for family preference visas. There are limitations on the number of F visas issued each year, and visas are issued in a certain order of preference based on the relationship between the sponsor and the family members who will be immigrating to the United States.
  • Fiancé (K) visas - A U.S. citizen can apply for this type of visa for a foreign fiancé. This will allow the fiancé to enter the United States, and once the couple is married, the immigrant spouse will receive a conditional Green Card.
